GENERAL SALES CONDITIONS
This section establishes the contracting and acquisition of the products through the website www.moringanatural.es, property of ADELA ROJA ROSALES (hereinafter NATURALEAF)
By accepting this contract, the consumer and/or user (hereinafter referred to as the customer) accepts the following:
1. That he/she is a person with sufficient capacity to contract.
2.    That he/she has read, understands and accepts without reservation each of the points of these general contracting conditions.
3.    That he/she assumes all the established obligations.

NATURALEAF does not process data corresponding to minors. NATURALEAF only sells to persons of legal age in accordance with Spanish legislation (article 315 of the Civil Code).
These conditions will be valid for an indefinite period of time and will be applicable to all contracts made through the website www.moringanatural.es.
NATURALEAF reserves the right to modify the contractual offer, constituted by these general conditions and the list of products and their prices, at any time, although such modifications will not be made with the contracts already made by the consumer and/or user previously. For all these reasons, we recommend that you read them before proceeding to purchase any product and/or service offered.

IDENTITIES OF THE PARTIES
On the one hand, ADELA ROJA ROSALES (Owner of the website: www.moringanatural.es) with NIF: 42094164R, as supplier of the products contracted by the consumer and/or user, with registered office at Calle El Sauzal Nº15 1º-16, 1D, 38611, Granadilla de Abona, Tenerife, Spain, contact email info@moringanatural.es and telephone (+34) 679721589.
On the other hand, the client, whose purpose is to be a consumer and/or user of the same and/or to contract the products or services of ADELA ROJA ROSALES (hereinafter NATURALEAF).

Communications between the customer and NATURALEAF by such means shall be considered effective and valid for all purposes.

he customer is responsible for the veracity of the data he/she provides to NATURALEAF and is therefore liable for the consequences that may arise from providing false or erroneous data on this website.
The customer must respect and accept the general contracting conditions, the legal notice, the conditions of use and privacy established on this website.
Failure to comply with the above may lead to the withdrawal or cancellation of the services by NATURALEAF without prior notice and without the right to any compensation, as well as the initiation of any legal action to which NATURALEAF may be entitled.
 
RESPONSIBILITY OF NATURALEAF
NATURALEAF undertakes to respect the obligations established in these general contracting conditions.
For any information or to resolve any doubts, the customer will have the form established for this purpose in the "Contact" section or by telephone (+34) 679721589, or by e-mail at info@moringanatural.es indicating the order number or stating their query.

LANGUAGES
The languages in which the relationship with the client is perfected will be Spanish and English.
 
OBJECT OF THE CONTRACT (DESCRIPTION OF THE PRODUCTS)
The purpose of this contract is to regulate the relationship between NATURALEAF and the customer at the time when the latter gives his consent during the contracting process by accepting the corresponding box. (Box which, prior to acceptance, will inform about these general contracting conditions).
The contractual relationship of purchase and sale will involve the delivery of a product in exchange for a price determined on the website.

CONTRACT PROCEDURE
The purchase of NATURALEAF products can be made in the following way:
We inform you that in accordance with the requirements of art. 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will follow the following steps:
 
1.- Registration (optional)
In order to simplify the purchase process as much as possible, the user can register through a form established for this purpose in the section "MY ACCOUNT", or when purchasing a product.
To carry out this registration, a user account will be created. To do so, the user must freely and voluntarily provide the personal data that will be required.
The user will select a user name and a password, and will undertake to make diligent use of them, and not to make them available to third parties, as well as to notify the provider of the loss or theft of them or of possible access by an unauthorised third party, so that the provider can proceed to block them immediately.
The user may not choose a user name that is intended to mislead others by identifying the user as a member of the provider, or to use expressions that are rude, offensive or generally contrary to the law or to the requirements of morality and decency.
Notwithstanding the above, the user may have the option of making the purchase without registering on the platform.
 
2.- choice of product and purchase
In the central and upper part are the different types of products.
Click on the desired category and choose the product you wish to purchase. Later a descriptive card will appear where it is detailed the characteristics of the same one and its price with IGIC, IVA or exempt.
2.    In the case that the selected product is not available as stock, it will appear expressly indicated and it will not be possible to add it "to the cart".
3.    To add the desired available product "to the cart", click on the link "buy" or "add to cart".  Subsequently, the purchase menu will appear, where the user will be able to know the total price of the purchase, as well as have the possibility of cancelling it through the Delete command.
4.    Once the selection of products to be purchased has been made, the buyer must fill in a form if he or she has not previously registered.  This filling in is done for the purpose of shipping, invoicing and managing your personal data.
5.    Once the purchase process has been completed, a summary of the previous process will appear with the data provided, so that you can either rectify any data or confirm your order.
6.    You will make the payment for the product according to the selected procedure.
7.    The purchase is completed.
8.    Once the purchase has been made, and within a maximum period of 24 hours (moons to Fridays, with the exception of national or regional holidays, when the period begins on the first working day), NATURALEAF will send a receipt for the purchase by e-mail.

PRODUCTS/SERVICES OFFERED
The main characteristics of each product/ are described in their corresponding sheets or sections. (Characteristics, price, offers, discounts, etc.)
The offers will be duly marked and identified as such, conveniently indicating the previous price and the price of the offer.
The sale of products will be carried out in Spanish territory, including Ceuta, Melilla, the Balearic and Canary Islands, countries within the E.U., and any country where there are no commercial restrictions related to NATURALEAF products, or shipping restrictions.

PRICE AND TERM OF VALIDITY OF THE PRODUCTS
The customer accepts that the economic valuation of some of the products may vary in real time. As a consequence, the price to be applied will be the one in force on the date of the order. Notwithstanding the above, this final price will be communicated to the customer in the electronic purchase process in advance and before the customer proceeds to formalise his or her acceptance of the purchase.
The prices indicated for each product do NOT include Value Added Tax (VAT or IGIC) and in any case will be expressed in Euro currency (euros).
VAT or IGIC tax rates may vary depending on the country of destination and the nature of the products in the order.
The prices indicated on the products, unless expressly indicated otherwise, do not include shipping costs, shipping insurance or any other additional services and annexes to the product purchased.
Notwithstanding the above, the customer may check and calculate the total price of the product with the exact breakdowns before proceeding to formalise the payment in the web purchase process.

PAYMENT METHODS
- By credit or debit card. By this means of payment, the customer will have to provide his card number, expiry date and CVV number. In this case, your data will be encrypted and sent under a secure server to the bank's virtual POS. This procedure does not provide the card number to NATURALEAF.
- By means of PayPal: In order for the customer to be able to pay for purchases through this system, he/she must have a PayPal account. For more information, please visit www.paypal.es.
 
DEADLINES AND DELIVERY OF ORDERS
The product will be considered as delivered to the customer when it is available to the customer and the customer signs for the receipt of the product at the Transport/ Post Office.
Orders will be delivered to the delivery address freely designated by the customer in the registration/purchase process once payment has been executed and confirmed.
Under no circumstances will NATURALEAF be held responsible when the product is not delivered as a result of false, inaccurate or incomplete data provided by the customer, or when the delivery cannot be made due to causes beyond the control of the entity in charge of the shipment, such as the absence of the recipient.
Deliveries will be made in accordance with the time limit established in the following table:
- MAILS (Canary Islands) 3 to 7 working days
- MAILS (Rest of Spain) 3 to 7 working days
- MAILS (E.U.) 5 to 14 working days
- MAILS (Rest of the world) 7 to 21 working days

Orders received before 10:00h will be sent that same afternoon. Those received after that time will be sent the next day
Saturdays, Sundays and public holidays in force in Spain will not be taken into account during these periods.
It is possible that the delivery may be delayed beyond the deadlines set, in this case, NATURALEAF will take the measures required of a diligent trader to ensure that the delivery can be made in the agreed time, and if not, within a maximum of 30 calendar days from the purchase of the product as specified in the current regulations on Consumers and Users (art. 109).
Should the product still not be delivered, the buyer is entitled to summon NATURALEAF to comply within an additional period of time appropriate to the circumstances. If the entrepreneur does not deliver the goods within this additional period, the customer is entitled to withdraw from the contract and the seller must reimburse all amounts paid by the buyer under the contract without undue delay.

SHIPPING COSTS
The scales established for calculating shipping costs depend on the region to which the product is to be sent, and the volume and weight of the order. Orders with a value of 90 ? or more are not subject to shipping costs in Spain or other EU countries. These details will be provided by the customer at the time of registration through the form.
Once the order has been placed and the amount confirmed, the system will calculate the cost of the shipping costs, for which the customer will be able to check the invoice of the purchase at any time on his screen, in which the costs of the order and the shipping costs will be broken down.

 
CLAIM OF NON-DELIVERED ORDERS:
Upon receipt of an e-mail stating that their order has been sent, if after a reasonable period of time they do not receive the product, they may contact NATURALEAF by telephone (+34) 679721589, using the "Contact" form or by e-mail: info@moringanatural.es in order to clarify the cause of the delay.
Once the complaint has been made, NATURALEAF will contact the customer in order to explain what has happened and reach an agreement on what has happened.

CANCELLATIONS
If, once the purchase has been made, you wish to cancel an order that has not yet been dispatched, you can do so as long as you indicate this on the contact form established for this purpose in the "Contact" section or in writing to the e-mail address info@moringanatural.es, customer service form or by telephone on (+34) 679721589, indicating the number of the order you wish to cancel.
 
FORCE MAJEURE
Neither of the contracting parties shall be liable for any fault of any kind due to force majeure. The termination of the contract will be postponed until the end of the situation of force majeure.
 
RIGHT OF WITHDRAWAL / RETURNS
NATURALEAF will only accept returns in the event that the product is not in good condition and the causes attributable to it are not the result of the customer. The latter shall be entitled to return the product, informing NATURALEAF of the reason for the return by any of the means provided in these contractual conditions, and at no cost to the customer. This return due to a defect or poor condition of the product shall not be considered a right of withdrawal.
NATURALEAF undertakes to assume the cost of the return and to return the product for a new one in accordance with the conditions accepted at the time of sale.
Procedure:
To exercise their right of withdrawal, the consumer and/or user has a period of 14 calendar days from receipt of the product. To do so, they must fill in the form established for this purpose in the "Contact" section.
Whether by one means or another, your communication must contain the following data:
- Your identification data: full name and address
- Order number on the invoice sent to you together with the purchased good
- Description of the acquired good
- Reason for return
- Your willingness to withdraw from the sales contract
- Bank account where you want the price and cost refund to be made
- Date of communication
- If you send your request by non-electronic means (e.g. mail) it must be signed.
From the date on which you inform us of your decision to withdraw from the contract, the consumer and/or user has a period of 14 calendar days to return the goods purchased to NATURALEAF in perfect condition, together with a copy of the purchase invoice.
NATURALEAF will promptly notify the consumer and/or user by e-mail of the acknowledgement of receipt of such withdrawal, with the instructions for dispatch by the consumer and/or user. Once the product has been received or the consumer and/or user has presented reliable proof of the return of the goods, NATURALEAF will deliver the sums paid by the consumer and/or user without undue delay.
 
APPLICABLE GUARANTEES
The contractual guarantee offered is that established in Royal Legislative Decree 1/2007, of 16 November, which approved the revised text of the General Law for the Defence of Consumers and Users. NATURALEAF will be liable for any lack of conformity that may arise within two years of delivery, provided that the customer has informed NATURALEAF of the said lack of conformity within two months of becoming aware of it. In the event of a defective product, the seller shall, as appropriate, repair, replace, reduce the price or terminate the contract.
 
COMPLAINT FORMS
By applying by mail to Calle El Sauzal Nº15 1º-16, 1D, 38611, Granadilla de Abona, Tenerife, Spain, the consumer and/or user has at his/her disposal complaint forms, in accordance with the competent regulations on this matter. Notwithstanding the above, the consumer and/or user may, in any case, request that they be sent to him/her by means of the contact form established for this purpose in the "Contact" section or to the e-mail address info@moringanatural.es.
